J&M Securities LLC, a Missouri-based collection agency, has had its request to dismiss an H&R Block lawsuit against it denied by a federal judge Monday, according to a story in the Kansas City Star.



H&R Block alleges that J&M Securities had tried ? at least 79 times from January 2005 to April 2005 ? to garnish the refunds of H&R Block clients. H&R Block claims that to do so, J&M Securities used confidential information it should not have. J&M Securities says that the information it used was obtained legally, using ?trade secrets.?



J&M Securities based its request to dismiss on the fact that H&R Block is not a provider of electronic communication services, yet it used the Electronic Communications Privacy Act as the backbone of its suit against J&M.
